LANSING – With the same cast returning for a repeat performance before the House Judiciary Committee that pushed the issue on both sides last session, the panel approved a package that would essentially erase the state’s product liability immunity law and put prescription drugs under consumer protection laws.

As they have in prior sessions, advocates of the change argued that current state law allows drug companies to act with impunity when it comes selling prescription drugs in the state. Opponents argued repealing the current law would further push the pharmaceutical industry out of the state.

Opponents picked up one more supporter over last session, with Rep. Rick Jones (R-Grand Ledge) this time opposing the three bills. Rep. Tory Rocca (R-Sterling Heights) was the sole member of his caucus to support the measures.

The main bill (HB 4316 ), repealing the current law, was reported 10-5, as was HB 4318 , moving pharmaceuticals to the Consumer Protection Act. HB 4317 , which would allow lawsuits under the new standards for incidents dating back to the 1996 passage of the current law, was reported 9-5, with Rep. Bettie Scott (D-Detroit) abstaining (a victory for supporters, as she opposed the measure last session).

With the bills now on the House floor, this marks the third consecutive session the chamber has addressed the issue and the anticipation is the second session it passes it. The Senate allowed the bills to die in the Judiciary Committee without hearing last session.
