FERNDALE – Is software patentable? Yes, according to attorney Andrew Basile Jr., managing partner of Young Basile, an intellectual property law firm based in Troy, but with offices in Ann Arbor, Chicago, and Silicon Valley. Basile is joined in the conversation by Keith Schonberger, an associate in the firm’s Troy office. Schonberger concentrates his practices on patent prosecution in the software field, namely in the areas of data processing, video coding, user interface and mobile technologies. He practices in further aspects of intellectual property law as well, including clearance studies, due diligence analyses and litigation support. Short answer, yes, you can patent software, but only under certain circumstances.
